This is a summary judgment motion filed in a medical malpractice case by the defendant doctor. This is a case wherein a doctor seeded cancer throughout a patient by improperly removing a tumor from the patient in a way that caused it to burst and parts of the tumor to touch uninfected portions of the body. This was a case for increased likelyhood of reoccurence of cancer. This motion was filed after the attorney of record the plaintiff withdrew, and the plaintiff was left without counsel. The motion claims that the plaintiff lacks the evidence necessary to go forward with the case.
